I, the undersigned participant, in consideration for being permitted to participate in the event hosted by TFOCB (“Event”), hereby acknowledge and agree to the following terms: Assumption of Risk: I understand that participation in the Event may involve certain risks, both known and unknown, including but not limited to personal injury, property damage, or death. I willingly and voluntarily assume all risks associated with my participation in the Event.Release of Liability: I hereby release, waive, and forever discharge TFOCB, its agents, employees, representatives, affiliates, partners, and any other parties acting on its behalf (collectively "Released Parties"), from any and all claims, actions, damages, liabilities, costs or expenses, whether known or unknown, arising out of or in any way connected with my participation in the Event. Indemnification: I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims arising out of or in any way related to my participation in the Event, including any claims caused by the negligence of the Released Parties or any third parties. Non-Refundable Ticket Policy: I acknowledge and agree that all ticket purchases for the Event are final and non-refundable. This policy applies regardless of any personal circumstances, changes in availability, or unforeseen events that may prevent attendance at the Event. Medical Treatment: I grant TFOCB permission to authorize emergency medical treatment if necessary. I understand that I will be responsible for any medical costs incurred as a result of such treatment. Photo and Video Release: I grant TFOCB the right to photograph, record, or videotape me and to use, reproduce, distribute, and display my image and/or likeness for promotional or any other purposes without further compensation or approval. Severability: If any provision of this Waiver and Release of Liability is deemed to be unenforceable, the remaining provisions will remain in full force and effect. Code of Conduct: All participants must adhere to the highest standards of personal conduct, respect, and inclusivity throughout the event. Any behavior contrary to these principles may result in immediate removal from the event and potential barring from future events. Intellectual Property Rights: Participants agree not to copy, distribute, display, or use any copyrighted or proprietary materials provided during the event without prior written permission from TFOCB or the rightful owner. Unauthorized use of these materials is strictly prohibited and may result in legal action. For-Profit Declaration: I acknowledge that TFOCB is a for-profit business dedicated to giving back to underserved communities. My participation and any contributions made during the event support TFOCB's mission to empower these communities through various initiatives, understanding that TFOCB operates with a business model aimed at both profit and social impact. Third-Party Activities Disclaimer: TFOCB shall not be held liable for any actions, omissions, or incidents arising from third-party services or activities (including those from vendors, sponsors, or partners) at the event. Participants agree to release TFOCB from all liability associated with such third-party engagements. Dispute Resolution: In the event of a dispute arising from this event, parties agree to seek resolution through mediation or arbitration, as alternatives to litigation, in accordance with TFOCB's dispute resolution policy. Governing Law: This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the jurisdiction where the Event is held. COVID-19 and Health Safety: I acknowledge that participation in the Event may carry the risk of exposure to COVID-19 or other communicable diseases. I agree to comply with all health and safety guidelines implemented by TFOCB and local authorities, including but not limited to wearing masks, social distancing, and any other preventive measures. I release TFOCB from any liability related to health risks, including COVID-19, that may arise from my participation in the Event. Damage to Venue and Equipment: I acknowledge that any damage caused by me to the venue or equipment used during the Event will be my financial responsibility. I agree to reimburse TFOCB for any costs incurred due to such damage. Personal Property: I understand that TFOCB is not responsible for the loss or theft of any personal property brought to the Event. I am solely responsible for the security of my belongings. Confidentiality and Non-Disclosure: I agree to keep confidential any proprietary or sensitive information disclosed during the Event, including business strategies, personal data of other participants, and any other information marked as confidential. Acknowledgment: I acknowledge that I have read and understood the terms of this Waiver and Release of Liability, and I am voluntarily waiving substantial legal rights (on my behalf and on behalf of my heirs, executors, administrators, and assigns).
